While we respect the jury's time and attention over the course of the trial, we do not agree with the verdict reached and continue to believe that BJ's and its Team Members treated the plaintiff appropriately.
We will be asking the court to reconsider the verdict and, if necessary, exploring our rights to appeal. The jury did not find she was a victim of discrimination based on sexual orientation but did find she was a victim of retaliation after she complained about discrimination. The jury found that Demas reasonably and in good faith believed that BJ's was engaged in wrongful discrimination, that Demas acted reasonably in response to that belief in opposing BJ's practice, that BJ's formed an intent to retaliate against Demas for complaining about BJ's discriminatory practices, and that BJ's retaliatory motive was a determinative factor in its decision to terminate Demas' employment.
