The woman originally told police that Waterbury requested sex, but that no physical contact occurred. Oakes noted that the woman suffers from substance abuse, possible mental health issues and has a criminal history. Oakes said there was no indication that the woman was intimidated into not testifying against Waterbury. The alleged encounter happened inside a vehicle off a roadway in a remote part of Oswego.
